Terms of Service

Last updated: August 2026

1. Introduction

These Terms of Service (“Terms”) govern your use of the StacksClub app and website, operated by StacksClub Pty Ltd (ACN 697 102 417) (“StacksClub”, “we”, “us”). By creating an account, you agree to these Terms and to our Privacy Policy.

2. Definitions

  • “Account” means your personal StacksClub user account.
  • “Squad” means the group of up to five users you are placed with, who must all complete each week's lessons before the squad progresses.
  • “Content” means the lesson, quiz and educational material we make available in the app.
  • “User Content” means anything you submit, including any future journal entries.

3. Eligibility

You must be 13 years or older to create a StacksClub account. By creating an account, you confirm that you are 13 or older and that the information you provide is accurate. If you are under 18, we recommend a parent or guardian is aware you're using the app, though StacksClub currently has no messaging or direct-contact features between users.

4. Creating an account

You need an account to use StacksClub. You agree to provide accurate information and to keep it up to date.

5. Account security

You're responsible for keeping your login details secure and for activity on your account. Tell us immediately at team@stacksclub.com if you think your account has been accessed without your permission.

6. Acceptable use

You agree to use StacksClub only for its intended purpose — your own financial education — and not to misuse the app, attempt to access other users' accounts, or interfere with its operation.

7. Prohibited conduct

  • Impersonating another person or your squad members.
  • Harassing, bullying or shaming other users, including about their financial situation or progress.
  • Attempting to access, scrape, or interfere with StacksClub's systems or other users' data.
  • Using StacksClub for any unlawful purpose.

8. Financial information and disclaimers

StacksClub provides general financial education content. It is not personal financial advice. See section 10 below.

9. Bank account connections — not currently offered

StacksClub does not connect to your bank account, and has no plans to for the foreseeable future. If this ever changes, this section will be rewritten and you will be asked to separately consent before connecting any bank account.

10. No financial advice

StacksClub's content, quizzes and any automated feedback are general information only. They do not take into account your personal objectives, financial situation or needs, and are not a recommendation to buy, hold or dispose of any financial product. Nothing in StacksClub is personal financial advice within the meaning of the Corporations Act 2001 (Cth), and you should consider seeking advice from a licensed financial adviser, or information from ASIC's Moneysmart service, before making significant financial decisions. If a future feature ever provides advice that is intended to be relied on as personal financial advice, we will hold the appropriate licence (or operate under an appropriate licensee) before offering it, and this section will be updated accordingly.

11. User-generated content and licence

You own your User Content. By submitting it, you give StacksClub a limited licence to store, display and process it for the purpose of operating the app. Any journal-type content you submit is private to you — StacksClub will not display it to your squad or any other user. This licence ends when you delete the content or your account, except to the extent it has already been included in de-identified, aggregated data you separately agreed to.

12. Intellectual property

StacksClub's lesson content, branding and app design belong to us or our licensors. You may use them only as part of your normal use of the app.

13. Community behaviour, clubs and squads

Your squad can see your nickname and your weekly completion status, as described in the Privacy Policy. Be respectful of your squad members.

14. Leaderboards — not currently offered

StacksClub does not currently include public leaderboards or rankings. If introduced, this section will describe what's shown, to whom, and how to opt out, before the feature launches.

15. Reporting, blocking and moderation

If another user is harassing you or misusing the app, you can report it at team@stacksclub.com. We may review reported content or conduct and take action, including removing content, restricting a feature, or suspending an account, where it breaches these Terms.

16. Suspension and termination

We may suspend or terminate your account if you seriously or repeatedly breach these Terms, after giving you notice and a reasonable opportunity to respond, except where we reasonably believe immediate action is needed to protect other users or StacksClub. You can stop using StacksClub and delete your account at any time.

17. Deleting your account

You can delete your account at any time in the app. See the Privacy Policy, section 16, for what happens to your data.

18. Third-party services

StacksClub may link to or rely on third-party services (for example, ASIC's Moneysmart, or a hosting provider). We're not responsible for third-party services we don't control.

19. Affiliate links and sponsorships — not currently offered

StacksClub does not currently include affiliate links, sponsorships or paid product placements. If this changes, we will clearly label any sponsored or affiliate content as such, consistent with ACCC guidance on influencer/affiliate disclosure, and this section will be updated before launch of that feature.

20. Advertising — not currently offered

StacksClub does not currently show third-party advertising.

21. Paid subscriptions — not currently offered

StacksClub is free for individual users. We don't currently charge users for access. If a paid tier is introduced for individuals, this section will set out pricing, billing, cancellation and refund terms consistent with the Australian Consumer Law before that tier launches. StacksClub's business model is built around free access for users, funded by partnerships with organisations such as superannuation funds, universities and employers, not user payments.

22. Billing, cancellation and refunds — not currently applicable

Not applicable while StacksClub is free for individual users. See section 21.

23. Consumer guarantees

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

24. Disclaimers

StacksClub is provided “as is”. While we work hard to keep lesson content accurate and up to date, we don't guarantee that the app will be error-free, uninterrupted, or that content is free from mistakes. Educational content is fact-checked against primary Australian sources, but figures like interest rates, thresholds and government scheme details change over time — always check current figures for a decision that matters.

25. Limitation of liability

To the maximum extent permitted by law, and subject to section 23 (Consumer guarantees), StacksClub's liability to you for any loss connected with your use of the app is limited to resupplying the relevant service or, where that isn't reasonably possible, the amount you've paid us for that service (which, for a free service, is nil). This limitation doesn't apply to loss caused by our fraud, wilful misconduct, or gross negligence, or to any liability that can't lawfully be limited.

26. Indemnity

You agree to indemnify StacksClub against losses we reasonably incur as a result of your breach of these Terms or your unlawful use of the app, except to the extent caused by our own act or omission.

27. Privacy

Our Privacy Policy explains how we handle your personal information and forms part of these Terms.

28. Changes to the service

We may add, change or remove features over time. We'll let you know about material changes that affect how the app works, particularly changes covered by the “not currently offered” sections above, before they take effect.

29. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll notify you in the app or by email with reasonable notice before it takes effect. Continuing to use StacksClub after a change takes effect means you accept the updated Terms; if you don't agree, you can stop using the app and delete your account.

30. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.

31. Dispute resolution

If you have a dispute with us, contact us first at team@stacksclub.com so we can try to resolve it directly. Nothing in this clause stops you from making a complaint to a relevant regulator (such as the OAIC) or pursuing your rights under the Australian Consumer Law.
